I am a plumber working for a XXX company who only wants to pay me commission per job. Yet im required to show up at the shop a 7:30 everyday and have to work until 5:00 at least. Im not paid for driving around. I dont get meal breaks, they constantly stack jobs and dont allow me a break. Im here over 40 hours and my checks are for 25-30 hours… how is this legal?

    1. You have to be paid for all hours you worked. Commissions do not compensate a plumber for all hours worked; they only compensate a plumber for the time actually earning the commission. The employer paying a plumber on a commission basis can face liability for unpaid minimum wages, denied rest periods, liquidated damages, and other penalties. Please give us a call at 805-641-6600 for more information.
