Employer Retaliation for Overtime Wage Claim

I told my employer that I was going to file an overtime wage claim for unpaid overtime and my employer retaliated against me. What should I do?

If your employer retaliates or discriminates against you in any way, you may file a discrimination/retaliation complaint with the Labor Commissioner’s Office. You can also file a lawsuit against your employer in court.

Example:

Joe decided to file an overtime wage claim in California against his employer to recover lost overtime wages. Joe told his employer that he was going to file a claim and as a result, Joe’s employer fired him. This is called retaliation and Joe can file a discrimination/retaliation complaint with the Labor Commissioner’s Office or file a lawsuit in court.
